Present petition has been preferred for issuing a direction to the respondent no. 2-Director General of Police, U.P., Lucknow and Superintendent of Police, District Mainpuri-respondent no. 3 to make payment of gratuity of Rs 9,8,590/- to the petitioner and also fix the final pension of late father of petitioner forthwith and with a further prayer to direct the respondent nos. 2 and 3 to decide the representation of the petitioner dated 19.01.2024.

Learned counsel for the petitioner has submitted that father of the petitioner had expired on 30.05.2018 while he was serving on the post of Constable. After his demise, the petitioner being the legal heir has made a representation for payment of pension and gratuity of his late father. On the representation of the petitioner, certain communication dated 07.08.2023 were made between the Superintendent of Police, Mainpuri and Superintendent of Police, Bulandsahar where late father of the petitioner was posted for removing the objections as pointed out by Finance Controller, U.P. Police Headquarter.

It is further submitted that the petitioner is running pillar to post but no payment has been made till date. When nothing was paid to the petitioner the petitioner has made a representation dated 19.01.2024 to the respondent no. 2 mentioning therein the financial hardship suffered by the family of the deceased employee including petitioner but till date no decision has been taken in the said representation.

After arguing at some length, learned counsel for the petitioner has confined his prayer to the extent that a direction may be given to the respondent no. 2 to consider and decide the representation of the petitioner dated 19.01.2024 within the time fixed by this Court.

Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioner.

On the request of learned counsel for the petitioner and without entering into the merit of the case, the present petition is disposed of with a direction to the respondent no. 2 to consider and decide the aforementioned representation of the petitioner dated 19.01.2024 in accordance with law within a period of six weeks from the date of production of certified copy of this order.
