Learned counsel for the petitioners has submitted that the present writ petition has been preferred for issuing direction to the respondent no.2 i.e. Director (Administration) Medical & Health Services, Swasthya Bhawan, Lucknow to take decision on the application dated 07.12.2023 preferred by the petitioner no.1 for his son i.e. petitioner no.2 for giving compassionate appointment to the petitioner no.2 on the post of Junior Clerk under Dying in Harness Rules, 1974 after the demise of husband of petitioner no.1 and father of petitioner no.2 who was expired on 17.12.2022 during his service tenure while working on the post of Sweeper within a stipulated time as this Court may fix.

Learned counsel for the State has no objection to the prayer made by learned counsel for the petitioners.

On the request of learned counsel for the petitioners, without entering into the merits of the case, the present writ petition is disposed of with a direction to the respondent no.2 i.e. Director (Administration) Medical & Health Services, Swasthya Bhawan, Lucknow to take a decision on the application/ representation of the petitioners in accordance with law, within a period of six weeks from the dated of certified copy of this order.
