Heard Shri Om Prakash Tripathi, learned counsel for the petitioner and learned Standing Counsel for the State.

The petitioner claims that he is entitled for arrears of salary. A representation has been made in this regard however the same has not been decided till date.

The only prayer made by the petitioner is that the said representation be decided within a stipulated period of time.

¶9

Learned Standing Counsel submits that claim of petitioner is required factual adjudication in accordance with the applicable law by the competent authority in the first instance. However, the claim of the petitioner is liable to be decided within reasonable time frame.

In the wake of preceding discussion and without going into the merits of the case, the interest of justice will be served by directing respondent No.3-District Magistrate, Muzaffarnagar to decide the claim of the petitioner for arrears of salary as per law, preferably, within a period of

three months from the date of receipt of a certified copy of this order.

With the aforesaid direction, the writ petition is finally disposed of .
