Heard learned counsel for the petitioner and learned Standing Counsel for the State.

This writ petition has been filed with the following prayer:-

"i. Issue a writ, order or direction in the nature of mandamus, commanding the Respondent no. 4 Deputy Director of Education (Secondary) 1st Region Meerut to resanction the pension and gratuity of the petitioner in the pay scale admissible to the Principal as per the last drawn pay of the petitioner, within stipulated period, as may be fixed by this Hon'ble Court."

It is contended by learned counsel for petitioner that petitioner was appointed as Principal of the Institution known as Nav Jiwan Inter College Bahsuma, Meerut on 01.04.2019 and he attained the age of superannuation on 31.03.2024. Though the salary of Officiating Principal was paid to petitioner but his pension has not been re-sanctioned and gratuity has not been paid in the pay scale admissible to the Officiating Principal. Ventilating his grievance, a representation has been made by petitioner before District Inspector of Schools on 10.08.2024 which is appended as annexure-7 to writ petition.

As no useful purpose would be served in keeping the matter pending, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 4 to decide the representation of petitioner dated 10.08.2024, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of production of certified copy of this order.

With the aforesaid directions, writ petition stands disposed of.

It is made clear that the Court has not adjudicated upon the merits of the case.
