Learned counsel for the petitioners submits that in regard to the commutation of pension, the petitioners are also entitled for the benefit of the interim order passed by this Court in Writ A No.5617/2024(Dr. Om Prakash Srivastava and others versus State of U.P. and others), as the recovery of the commutation amount cannot be continued after 10 years 11 months, whereas the PPO of the petitioners have been revised, which indicates that the notional pay have been fixed w.e.f. 01.01.2016 and revised pension from the said date, whereas the petitioners had retired way back in the year 2011,2012 and 2013.
Learned Standing Counsel does not dispute the aforesaid. However, he prays for some time to seek instructions in regard to revised PPO.
As prayed, list on 02.01.2025 as fresh.
