Heard Sri Aaditya Vikram Bisen, Advocate holding brief of Shri Samarath Singh, the learned counsel for the petitioner, Sri Pradeepta Kumar Shahi, the learned Additional Chief Standing Counsel appearing on behalf of the opposite parties no.1 to 4 and perused the records.

By means of the instant writ petition filed under Article 226 of the Constitution of India the petitioner has challenged the validity of an order dated 06.02.2024, passed by the Regional Level Selection Committee headed by the Joint Director of Education, Jhansi Region, Jhansi refusing to regularize the services of the petitioner on a post of Assistant Teacher, LT Grade in Shri Beer Singh Inter College, Babina, Jalaun.

The petitioner was appointed as Assistant Teacher on ad-hoc basis by means of an order dated 25.09.1996 and the District Inspector of Schools had granted approval to his appointment by means of an order dated 25.1.1999. The petitioner is working on the aforesaid but he is not being paid his salary.

The matter requires detailed consideration.

Issue notice to the opposite party no.5, returnable at an early date.

one week from today.

The opposite parties may file their counter affidavits within four weeks. In case counter affidavit is filed the petitioner may file a rejoinder affidavit, if any, within two weeks' thereafter.

List this case in the week commencing 21.10.2024.

In view of the aforesaid facts, as an interim measure it is provided that till the next date of listing the operation and implementation of the impugned order dated 06.02.2024, passed by the Regional Level Selection Committee headed by the Joint Director of Education, Jhansi Region, Jhansi shall remain in abeyance and the petitioner will be permitted to continue to work on the post of Assistant Teacher and be paid his salary regularly.
