At the very outset, learned counsel for the petitioners states that he does not want to press the instant writ petition so far as it pertains to the petitioners no. 14, 15, 17, 18, 19, 23,28, 31 & 34 and prays that the instant writ petition may be dismissed as not pressed so far as it pertains to the petitioners no. 14, 15, 17, 18, 19, 23,28, 31 & 34 with liberty to file a fresh writ petition.

To the aforesaid prayer, learned counsel appearing on behalf of the contesting respondents have no objection.

Accordingly, the writ petition is dismissed as not pressed so far as it pertains to the petitioners no. 14, 15, 17, 18, 19, 23,28, 31 & 34 with the aforesaid liberty.

Heard learned counsel for the petitioners, learned Standing counsel appearing on behalf of the respondent no. 1 & 3, Sri Piyush Kishore, Advocate holding brief of Sri Neerav Chitravanshi, learned counsel for the respondent no. 2, Sri Ashutosh Mishra, learned counsel for the respondent no. 5 and Sri Mohit Chandra, Advocate holding brief of Sri Puneet Chandra, learned counsel for the respondent no. 6.

Issue notice to the respondent no. 4 returnable at an early date.

Steps be taken within a week.

There is consensus at Bar that so far as interim relief in the matter is concerned, same is squarely covered by the order dated 26.09.2024 passed in Writ A No.8026 of 2024 In re Bharat Singh & 29 Ors vs State of U.P. & 3 Ors.

Considering the aforesaid consensus, it is provided that no further recovery shall be made from the petitioners till the next date of listing.

The respondents may file a counter affidavit within a period of four weeks to which reply may be filed within next two weeks.
