Heard learned counsel for the petitioner, Sri Nitin Mathur, learned Additional Chief Standing counsel appearing on behalf of the respondents no. 1 to 3 and Sri Dilip Kumar Pandey, learned counsel for the respondent no. 4.

No notice need be issued to the respondents no. 5 to 9 taking into consideration the nature of order proposed to be passed.

Instant writ petition has been filed praying for a mandamus commanding the respondents no. 1 to 5 to remove the encroachment from over Gram Sabha Land of Gata No. 328 area 0.8250 hectares situated in Village-Ram Nagar Khurd, Pargana- Srinagar, Tehsil- Lakhimpur District- Kheri.

Sri Nitin Mathur, learned Additional Chief Standing counsel on the basis of instructions sent by Tehsildar, Lakhimpur Kheri states that four persons were found to have encroached on the aforesaid land and the proceedings under Section 67 of the Uttar Pradesh Revenue Code, 2006 (hereinafter referred to as "Code, 2006") against the said four persons have been initiated and endevour would be made to conclude the same in accordance within the time as specified under the Code, 2006 and the rules governing the same.

The aforesaid statement is recorded and the writ petition is disposed of.
