This Court vide order dated 22.08.2024 had issued card notice to the appellants after the demise of their counsel Late H.S.Sahai.
In compliance of the order of this Court, notice was sent to appellant nos.1 to 3. As per office report dated 05.12.2024 service upon appellant no.3 is sufficient by way of notice "served personally" and 'appellant nos.1 and 2 are reported dead'.
Neither anyone has filed Vakalatanama on behalf of appellant no.3 despite notice having been served personally upon him nor anyone is present to press the second appeal.
Accordingly, the second appeal is dismissed for want of prosecution.
