Shri Shailesh Chandra Tiwari, learned counsel for the appellant submits that the caveator counsel had refused to accept the notice, therefore, the notice had been sent to the respondents through registered post. However, the office reported a defect that the copy not served to the caveator counsel, therefore, a copy was served to the caveator counsel through speed post but it appears that since he had refused to accept the notice, therefore, he has not appeared and has sent illness slip and opposes the request for adjournment. However, there is an illness slip of the caveator's counsel and a copy has been served by the appellant, the case is adjourned for the day.
List on 02.01.2025 as fresh.
It is made clear that the case shall not be adjourned on the next date on any ground. In case the learned counsel for the caveator has any difficulty to appear, he may make an alternate arrangement, failing which the appropriate order may be passed by this Court.
