Heard learned counsel for the appellant and Sri Sudeep Seth learned Senior Advocate assisted by Sri Divyanshu Bhatt and Sri Shashwat Singh, learned counsel for the respondents.
Learned counsel for the appellant submits that the instant appeal has lost its efficacy, inasmuch as, the parties have entered into compromise before the Executing Court. In this regard, the appellant moved an application no.04 of 2024 duly accompanied by an affidavit which also has copies of the compromise as well as order passed by the Executing Court dated 29.01.2024.
Having considered the aforesaid, the instant appeal is dismissed as not pressed.
