Shri Asit Srivastava, on the basis of instructions, submits that the appellant wants to withdraw this appeal and the total decretal amount has already been deposited under the orders passed by this Court, which may be released in favour of the respondents.
In view of above, the appeal is dismissed as withdrawn.
The amount of statutory deposit and any other amount deposited before this Court under any order of this Court shall be remitted to the concerned tribunal for adjustment in compensation to be paid to the claimant-respondents under the impugned judgment and award passed by Motor Accident Claims Tribunal/Additional District Judge, Court No. 5, Barabanki in M.A.C. No. 352 of 2008; Shehnaz Bano and another vs. The New India Assurance Company Limited and others forthwith, and in any case, within 10 days from today.
