The order dated 07.02.2024 passed by Additional District and Session Judge, Court No. 1, Fatehpur whereby the revisionists have been summoned in exercise of powers under Section 319 Cr.P.C. as an additional accused is the subject matter of challenge in the present criminal revision.
On the matter being taken up, Mr. Vimlendu Tripathi, learned counsel for the revisionists submits that during pendency of this criminal revision, the revisionists have been acquitted by the trial Court vide judgment and order dated 29.06.2024, therefore, cause of filing the instant criminal revision has lost its efficacy.
Learned A.G.A. representing the State and Mr. Devesh Kumar Gupta, learned counsel for opposite party no. 2 do not dispute the said fact.
In view of the above, the instant criminal revision is dismissed as having been rendered infructuous.
