1. Heard learned counsel for the revisionist, learned Additional Government Advocate for the State on this criminal revision filed against order dated 5.3.2024, passed by Addl. Principal Judge, Room No.3, Family Court, Lucknow in Crl. Case No.1406 of 2015 Smt. Rekha Singh versus Sujeet Singh alias Manish under section 125 CrPC, whereby the revisionist has been directed to pay a sum of Rs.8000/- per month to private respondent No.2 from 25.11.2015 to 29.1.2018 and Rs.9000/from 6.3.2021 to the date of the judgment as also Rs.10,000/per month from the date of the judgment, and perused the record.

2. Notice to respondent No.2 is dispensed with in view of the proposed order.

3. Learned counsel for the revisionist submits that an exorbitant amount has been fixed by the Family court ignoring the fact that the revisionist is unemployed.

A perusal of issue No.3 shows that the learned Family Court while deciding the said issue has considered written statement of the revisionist, however, it has given a finding that the revisionist has not disclosed name of his employer although, he has admitted that he is employed. He has also not produced his salary certificate, although, it is expected in terms of the judgment of Rajnesh versus Neha. The original copy of alleged termination letter has also not been filed and the letter has not been certified by the revisionist in his examination in chief nor he has stated as to which officer has issued this letter. The finding given by the learned Family Court on issue No.3 is extracted below :

" ननिस्ततारण अवधतारर नबिन्दद ससंख्रता-3

(13) भरण पपोषण पताररनिता पत्र ककी धतारता 14 मम पतारररनिनी ककी ओर ससे कहता गरता नक नवपकनी पताईवट कम्पनिनी मसे जताबि करकसे 35,000/- रुपरसे मतारसक कमतातता हहै और उसकसे पतास दपो पपोल्टटनी फतामर हताउस हहै। समस्त स स ंताधतानिपो ससे उसककी पनत मताह आर 1,25,000/- रुपरसे हहै। बिततौर पनी०डब्ललू०-1 पतारररनिनी निसे कहता हहैनक मसेरसे पनत सनी०एम०एस० इनिफपोनटक पताइवसेट रलनमटसेड मसे कताम करतसे हहै। नवपकनी निसे रलरखित करनि मम रह मतानिता हहै नक वह पताईवसेट कम्पनिनी मम कताम करतता हहै लसेनकनि मतारससंक आर कसेवल 6000/- रुपरसे बिततारनी हहै। रसे महत्वपलूणर हहै नक नवपकनी निसे तता तपो रलरखित करनि मसे नि हनी रजनिसेश बिनिताम निसेहता कसे शपर पत्र 35 अ मसे ननिरपोजक कता निताम बिततारता हहै। नवपकनी निसे अपनिता वसेतनि पमताण पत्र भनी पस्तदत निहनी नकरता हहै जबि नक मतानिनिनीर उच्चतम न्रतारतालर दतारता रजनिसेश बिनिताम निसेहता कसे ननिण ननिधता र रत शपर पत्र कसे पतारुप मसे उक्त तथ्र व अनभलसेखि अपसेनकत हहै।

(14) चलूचूँनक नवपकनी निसे ननिरपोजक दतारता जतारनी वसेतनि पमताण पत्र पस्तदत निहहीं नकरता हहै और वमतनि कसे सम्बिन्ध मम रलरखित करनि तरता मदख्र परनीकता मम अससंगत करनि नकरसे हहै। (रलरखित करनि मम वसेतनि 6000/- रुपरसे जबि नक बिरतानि मम 7200/- रुपरसे पनत मताह बिततारनी हहै) इसरलए वसेतनि कसे सम्बिन्ध मम उसकता बिरतानि भरपोसता करनिसे लतारक निहहीं हहै।

(15) नवपकनी निसे बिरतानि मम कहता हहै नक वतरमतानि समर मम मम बिसेरपोजगतार हहचूँ। सलूचनी 251/2 ससे पपत्र ससंख्रता 25 ग/13 टरनमनिसेशनि लसेटर नदनितासंनकत 09 जलूनि 2022 रह दनशरत करनिसे कसे रलए पस्तदत नकरता हहै नक उससे नितौकरनी ससे ननिकताल नदरता गरता हहै। परन्तद नवपकनी निसे अपनिनी मदख्र परनीकता मम इस पपत्र कपो पमतानणत निहहीं नकरता हहै और नि हनी रह बिततारता हहै नक रह पपत्र नकस पतारधकतारनी दतारता जतारनी नकरता गरता हहै। इसरलए रह पपत्र और नवपकनी कता करनि भरपोसता करनिसे लतारक निहनी हहै।

(16) नवपकनी निसे मदख्र परनीकता मम कहता हहै नक उसकसे पतास कपोई पपोल्टटनी फतामर निहनी हहै लसेनकनि चलूसंनक रलरखित करनि ककी धतारता 14 निसे पपोल्टटनी फतामर हपोनिसे ससे स्पष्ट रुप ससे इसंकतार निहहीं नकरता हहै इसरलए मतानिनिसे रपोग्र निहहीं हहै। पनी०डब्ललू०-2 नवजर जपो पतारररनिनी कता भताई हहै निसे कहता हहै नक वह और उसकसे नपतता नवपकनी और उसकसे नपतता कसे सतार पपोल्टटनी फतामर पर गरसे रसे। रसे फतामर नवपकनी कसे घर ससे आधता नकलपो मनीटर ककी दलूरनी पर हहै।

(17)पतारररनिनी निसे मदख्र परनीकता मसे नवपकनी कपो मकतानि कसे नकरतारसे ससे भनी 40-50 हजतार रुपरसे पनतमताह आमदनिनी हपोनिता कहता हहै लसेनकनि नवपकनी निसे इसससे इसंकतार नकरता हहै और पतारररनिनी निसे इसकता कपोई नवश्वसनिनीर सताक्ष्र पस्तदत निहहीं नकरता हहै।

(18) नवपकनी कसे करनि ककी अपसेकता पतारररनिनी कता करनि अरधक नवश्वसनिनीर हहै नक नवपकनी

सनीएमएस इन्फपोटसेक मम 35000/- रुपरसे पनत मताह वसेतनि पर नितौकरनी करतता हहै और उसकसे पतास पपोल्टटनी फतामर भनी हहै। लसेनकनि समस्त सपोतपो ससे नवपकनी ककी आमदनिनी 1.25,000/रुपरसे हपोनिता पतारररनिनी दतारता बिढता कर बिततारनी गरनी पतनीत हपोतनी हहै। नितौकरनी ससे 35,000/रुपरता पनत मताह वसेतनि और पपोल्टटनी फतामर ससे आसंमदनिनी नमलता कर 50,000/- रुपरता पनत मताह नवपकनी ककी कदल आमदनिनी ससे अरधक हपोनिता नवश्वसनिनीर निहनी लगतता हहै। अवधतारर नबिन्दद तदनिदसतार नकरता जतातता हहै।"

5. It is not in dispute that respondent No.2 is legally wedded wife of the revisionist. She is destitute and is unable to maintain herself. She has been subjected to cruelty relating to demand of dowry and that is why, she is residing with her parents.

6. On due consideration to the submission advanced, perusal of the record as also the order impugned, I find no illegality in the impugned order.

7. The revision being devoid of merit is dismissed.
