1. Heard Sri Anoop Trivedi, learned Senior Advocate assisted by Sri Sumit Kumar Srivastava, learned counsel for the revisionsit and learned AGA for the State.

1. At the outset, learned counsel for the revisionist submitted that instant criminal revision has been preferred against the dismissal of the discharge application filed by the revisionist/accused vide order dated 19.2.2024 passed by learned Additional Session Judge/Fast track Court -Ist Basti, in S.T. No. 377 of 2023 under sections 376, 342, 323, 506, 34, 120-B I.P.C., P.S. Kotwali, District Basti.

1. The Chief Judicial Magistrate, Basti had passed an order on 5.12.2018 in Misc. Case No. 415 of 2018 whereby further investigation was directed in the case and necessary orders were passed by the Court for compliance to DIG, Basti. However, the said order was stayed in Application U/S 482 No. 26280 of 2019 vide order dated 8.7.2019 passed by this Court and the said application under section 482 is still pending and the same is liable to be connected with present revision.
