Under challenge is the order dated 07.09.2024 passed by learned Additional Principal Judge, Ist, Bahraich in Criminal Appeal No. 47 of 2023 and order dated 03.03.2024 passed by Nyayadhikari, Gram Nyayalaya, Napara, Bahraich in Misc Criminal Case No. 104/11/2021 in re: Smt Suman Kumari vs Jitendra Sharma whereby interim maintenance of Rs 3000/- per month has been granted.
Various grounds have been raised by learned counsel for the revisionist in order to challenge the order of maintenance whereby interim maintenance has been granted in favour of respondents.
The Court is of the view that the aforesaid grounds can very well be considered by learned court before whom the application is still pending for considering.
Considering the aforesaid the revision is disposed of leaving it open to the revisionists to raise the aforesaid grounds as aforesaid to the court concerned.
In case the said grounds are raised the court below shall proceed to consider the same in accordance with law while deciding the matter finally provided there is no legal impediment.
