Heard learned counsel for the revisionist and learned A.G.A. for the State. No notice is required to be issued to private respondents for the order proposed to be passed.

Instant revision under Section 19(4) of the Family Court Act has been filed aggrieved against the order dated 08.07.2024 passed in Misc Case No. 218 of 2023 in re: Maya Devi vs Sheela Devi & Ors whereby learned Principal Judge, Family Court in the application filed under Section 126(2) of Cr.P.C. while allowing the application for recall of the ex-parte order dated 17.09.2021 passed under Section 125 of Cr.P.C. whereby an amount of Rs.5,000/- per month had been granted to the respondents no.2 to 4 herein, has required the revisionist to give cost of Rs.60,000/- for recall of the said order.

Learned counsel for the revisionist fairly states that in case the aforesaid cost of Rs.60,000/- is adjusted towards the maintenance which is to be paid to respondents no.2 to 4 he would not have any objection.

Considering the aforesaid, the revision is disposed of leaving it open to the revisionist to file an application before the learned court praying for adjustment of the cost as awarded vide order dated 08.07.2024 towards the maintenance as payable to the respondents no.2 to 4 in pursuance to the order dated 17.09.2021 or any interim

maintenance which may be fixed by the learned court.

In case such an application is filed then the learned court would proceed to decide the same in accordance with law after hearing all the parties concerned provided there is no legal impediment.
