1. Heard the learned counsel for the petitioner, learned A.G.A. for the State and Dr. Shantanu Sharma, Advocate appearing for the respondent No.5, who has filed his vakalatnama in Court today, which is taken on record.
2. This petition has been filed by the petitioners with the following main prayer :-
"(i) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties specially opposite party no.3, 4 and 5 not to harass the petitioners and the family members of the petitioner no.2 in any manner, in the interest of justice."
3. It has been submitted by the learned counsel for the petitioners that the petitioners are the family members of the main accused, Ankit, who ran away with the daughter of the informant and married her thereafter.
4. The counsel for the petitioners submits that Ankit along with the daughter of the informant had approached this Court in Criminal Misc. Writ Petition No.423 of 2024 wherein this Court has pleased to grant interim protection on 19.01.2024 and has granted interim protection. The matter is now listed on 26.02.2024.
5. Dr. Shantanu Sharma, Advocate has produced before this
Court a copy of the High School Examination result of the daughter of the informant showing her to be born on 15.04.2006 and it has been argued that consent of a minor is no consent and marriage between the main accused and the daughter of the informant is unlawful.
6. List and connect with Criminal Misc. Writ petition No.423 of 2024 on 26.02.2024.
7. Dr. Shantanu Sharma, Advocate shall file a counter affidavit on behalf of the informant, in the meantime.
8. When the case is listed next, the name of Dr. Shantanu Sharma, Advocate shall be shown in the cause list as learned counsel for respondent No.5.
