Heard leaned counsel for the petitioners, learned AGA on behalf of the State-respondents and perused the record.

This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of Certiorari for quashing the First Information Report dated 28.3.2024 registered as Case Crime No. 00172 of 2024 under Sections 498A, 323, 504, 506, 376, 328 IPC and Section 3/4 of D.P. Act, P.S. Akbarpur, District Ambedkar Nagar and for a direction to the respondents not to take any coercive measures against the petitioners pursuant to the impugned FIR.

Learned AGA, on the basis of his instructions, states that Sections 376 and 328 IPC are dropped during investigation.

At this stage, learned counsel for the petitioners submits that petitioners are ready to settle the dispute between the parties by way of mediation and to show their bona fide to settle the dispute, they are also ready to deposit Rs. 1,00,000/- by way of bank draft in favour of respondent no. 4. He further submits that the said amount may not be refunded, in case, mediation is failed. In case mediation succeeds, the amount may be adjusted in the final settlement.

Learned counsel for the petitioners further submits that he may be granted some time to produce the said bank draft in favour of the respondent no. 4 before this Court.

Let the draft of Rs. 1,00,000/- in favour of respondent no. 4 be produced before this Court on 6.5.2024.
