Heard learned counsel for the petitioner, learned counsel for the respondent and learned A.G.A. for the State respondents.

The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 13.05.2014 arising out of F.I.R. No. 70/2024 registered as Case Crime No. 191 of 2014, under sections- 419, 420, 467, 468, 471, 409 IPC and Police Station- Mursan District - Hathras and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report.

There is allegation against the petitioner that he has misappropriated the public money given by the District Minority Welfare Department.

Learned counsel for the petitioner submits that he received the money from District Minority Welfare Officer and disbursed it to the students and other beneficiaries in accordance with law. There was no offence committed by the petitioner.

Petition is disposed of directing that till cognizance is taken on police report under Section 173(2) Cr.P.C., by the court the respondents shall not arrest the petitioner pursuant to the First Information Report, subject to cooperation in ongoing investigation.
