Heard learned counsel for the petitioner and Mrs. Manju Thakur AGA-I for State-respondents.

On 03.10.2024 the following order was passed by this Court which is as follows:-

"1. Instant petition under Article 226 of the Constitution of India has been preferred by the petitioner praying, inter alia, for the following relief:

"Issue a writ order or direction in the nature of mandamus directing/commanding the respondent No.4 to release the pickup vehicle No. BR-28-GA-3116 with immediate effect to the petitioner, in pursuance of order dated 11.03.2024 and 06.04.2024 passed by Civil Judge (S.D)/ACJM, Kushinagar at Padrauna, in release application of petitioner."

2. Learned counsel for the petitioner submits that despite orders of release of vehicle dated 11.03.2024 and 06.04.2024 passed in his favour by the court concerned, his vehicle is not being released by respondent No.4.

3. Put up this case as fresh on 16.10.2024.

4. Meanwhile respondent No.4 will file his personal affidavit explaining as to why he has not released the vehicle of the petitioner.

5. In case no affidavit is filed, respondent No.4 shall be present in court on the next date at 10:00 a.m sharp"

In compliance of the order dated 03.10.2024 learned A.G.A.-I has filed personal affidavit of respondent no. 4 wherein it has been stated that the vehicle in dispute has been released in favour of the petitioner on 04.10.2024.

In view of the personal affidavit of respondent no. 4 the writ petition is dismissed as infructuous , since no further relief has been prayed by the petitioner.
