Heard Sri Shiv Pal Singh, learned counsel for the applicant.

It has been submitted by learned counsel for the applicant that grievance was raised before this Court with regard to regularisation of services of the applicant on the post of Chowkidar as well as grant of minimum pay-scale to the petitioner by filing a writ petition being Writ - A No. 1505 0f 2004. The aforesaid writ petition was disposed of by means of judgment and order dated 24.08.2023, with direction to the respondents to pay current wages equivalent to the minimum of pay scale admissible to Class IV employees within a period of six weeks from the date of production of certified copy of this order.

The State being aggrieved by judgment and order dated 24.08.2023, filed Special Appeal (D) No.91 of 2024, which was disposed of by means of order dated 27.02.2024 and the order of writ Court was modified to the extent that the petitioner instead of being granted the benefit of minimum pay-scale may be paid the daily wages as per the Government orders issued from time to time looking to his category classified as skilled and semi-skilled. The Division Bench also provided that the benefit shall be available to the petitioner from the date of institution of writ petition with future benefits.

It is after disposal of writ petition that the order of writ Court as well order passed by the Division Bench in Special Appeal was communicated to respondent nos. 2 and 3 on 14.03.2024. It is stated that despite expiry of the time period provided by the writ Court, the respondents have failed to comply with the same and hence have wilfully and deliberately disobeyed the aforesaid orders.

Accordingly, issue notice to respondent nos. 2 and 3, to show cause as to why they may not be punished for willful and deliberate disobedience of the judgment and order dated 24.08.2023, passed in Writ Petition No. 1505 of 2004 (Amar

State of U.P. and Others) as well as judgment and order dated 27.02.2024, passed by the Division Bench of this Court in Special Appeal (Defective) No. 91 of 2024 (State of U.P. through Principal Secretary, Basic Education Department, Government of U.P., Lucknow and others Vs. Amar Singh). Let necessary steps be taken within next ten days.
