Learned counsel for the respondent, while filing afÏdavit of compliance, informs that the order of Sub Divisional OfÏcer dated 22.11.2014 passed under Section 41 of the U.P. Land Revenue Act was challenged before the Additional Commissioner (Judicial), Devi Patan Mandal, Gonda in Appeal No. 12, under Section 210 of U.P. Land Revenue Act, which was decided on 09.04.2015. Against the said appellate order, Revision No. 73/2020/Balrampur was filed by the parties under Section 219 of U.P. Land Revenue Act, in which, relevant record has been summoned and same is pending. It is, thus, submitted that the demarcation order cannot be executed.

The afÏdavit of compliance is taken on record.

Learned counsel for the applicant does not dispute that the proceeding is pending before the Board of Revenue.

Accordingly, contempt application is hereby dismissed with the liberty to the parties to take appropriate steps, after decision of the aforesaid revision pending before the Board of Revenue, in accordance with the provisions of Para 460 of U.P. Land Revenue Code Manual.
