Heard learned counsel for the applicant, Sri Hom Narayan Awasthi, learned counsel for the complainant as well as learned A.G.A. and perused the record.

2 . It is argued by the counsel for the applicant that the co-accused, who is the mother in law, was enlarged on bail vide order dated 28.08.2024. The applicant herein is the father in law.

3. Learned A.G.A. as well as the counsel for the complainant opposed the bail prayer.

¶9

4. Considering and adopting the reasoning as contained in para 3 and 5 of the said order, the applicant is enlarged on bail on the ground of parity. Accordingly, the bail application is allowed .

5. Let the applicant Roshan Kumar be released on bail in FIR/ Case Crime No. 0251 of 2024, under Sections 498-A, 304-B IPC and Section 3/4 D.P. Act, Police Station Ramgaon, District Bahraich, on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶12

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶13

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
