As per the prosecution story, it has been alleged that when the complainant was engaged in the marriage ceremony of the daughter of his 'Bua' at Ishwar Palace, Mohalla Allapur, Shahbad on 28.11.2021, at about 11:30 p.m., his minor son was abducted by the applicant, and when the applicant and other persons started searching for the victim, it was found that the present applicant wanted to run away alongwith the victim and that period of time, the victim was unconscious. It has been contended by learned counsel for the applicant that the applicant is innocent and he has falsely been implicated due to ulterior motive. He next added that in fact, under the suspicion, the applicant was named in the First Information Report, though there was no criminal intent to commit abduction of the victim. He added that the applicant, by chance, was on the third floor wherein the victim was recovered and, therefore, the applicant is named in the First Information Report, on the basis of allegations levelled against him that he wanted to run away alongwith the victim, though there is no cogent piece of evidence against him as there was no mens rea r egarding committing the offence. He next added that the the statements of the informant, i.e. father of the victim, mother and two other eye witnesses have been recorded by the trial court, wherein they have denied the occurrence of incident and even the mother has stated the statement under Section 161 Cr.P.C. has falsely been recorded by the police, though no such statement was ever given by her.
