In terms of the F.I.R., it was alleged that on 01.08.2023 on account of financial dealing an altercation took place and the applicant administered some poison through a tea, which resulted into the death of the husband of the informant. In the light of the said, the counsel for the applicant argues that prior to the lodging of FIR, it was stated by the informant herself that the husband of the informant had gone to relieve himself, when he was beaten by a snake and had died on account of snake bite. He also draws my attention to the inquest report, wherein prima facie a view was expressed by the Punch that the death had occurred on account of snake bite. Subsequently, in the FSL report, the cause of death is shown as Aluminum Phosphide (poison). In the light of the said, the submission of the counsel for the applicant is that apart from the statement of the informant, nothing exists against the applicant so as to link to the applicant with the offence in question. The post mortem report does not indicate any injury. One of the statement of one Kamlesh referred to the bail rejection order wherein victim had stated that brother of the deceased had himself informed him that the applicant had administered any poisonous substance through a tea, based upon the said statement, the applicant is in custody since 13.10.2023.
