Heard learned counsel for the applicant and learned AGA for the the State as well as learned counsel for the complainant.

It is alleged in the FIR that the informant married his daughter Khushbu to the applicant on 20.06.2014 to the applicant. Immediately after few a days of the marriage, she was subjected to cruelty. A complaint was given by the informant to that effect in the police station. Thereafter a compromise happened and after a few days again she was subjected to beatings. The complainant tried several times to pacify the situation, however, since the accused were demanding dowry, they ultimately on 12.06.2021 killed his daughter and hanged her.

Learned counsel for the applicant submits that he has no criminal history. He is innocent and he has been falsely implicated. The FIR is after thought and has been lodged levelling false allegation of demand of dowry only in vengeance.

Learned AGA as well as learned counsel for the complainant has opposed the bail application submitting that apart from the ligature mark, there are six antemortem injuries on the person of the victim for which no explanation could be given by the applicant. The deceased died within seven years of marriage due to demand of dowry. It is a heinous offence and hence, the bail application of the applicant is liable to be rejected.

On due consideration to the postmortem report as well as seven antemortem injuries on the body of the deceased, so also the fact that she died within seven years of marriage and the statements of the prosecution witnesses, there is clear allegation of demand of dowry on several occasions, I am of the view that the applicant is not entitled to be enlarged on bail.

Accordingly, the bail application of the applicant namely Mohd. Sohel involved in Case Crime/FIR No. 325/2021, under Sections 498A/304(B) IPC and Section 3/4 of D.P. Act, Police Station - Mohammadi, District - Khiri is hereby rejected.
