It is submitted by learned counsel for the applicant that applicant is innocent and has falsely implicated in the present case. The first information report was lodged against the applicant and two other co-accused persons in Police Station Kumarganj, District Ayodhya, under Sections 420, 467, 468, 471, 406 I.P.C. and case was registered as Case Crime No. 0155 of 2020. The applicant had already granted bail by coordinate Bench of this Court, vide order dated 26.07.2021, passed in Bail No. 1004 of 2021. Copy of bail order is annexed as Annexure No. 2 to the affidavit filed in support of bail application. The Investigating Officer after investigation has submitted charge sheet by adding Sections 409 and 120B I.P.C.. It is further submitted that the dispute between the parties are purely of civil nature and the first information report has been lodged by informant only to create pressure upon the applicant and other co-accused persons. The criminal history of the applicant has been explained in para no. 12 to the affidavit filed in support of bail application. Lastly, it is submitted that since the applicant has already granted bail by the coordinate Bench of this Court, vide order dated 26.07.2021, passed in Bail No. 1004 of 2021, the applicant is entitled to be released in added sections i.e. under Sections 409 and 120B I.P.C. The accused-applicant is prepared to furnish the surety and bond and is giving undertaking that he will cooperate in trial. There is no possibility of fleeing away from the judicial process or tampering with the witnesses and in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. The applicant is in jail since 03.11.2020.
