Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

The applicant seeks enlargement on bail in FIR/Case Crime No.405 of 2024, under Sections 143, 147, 148, 149, 323, 304, 504, 506 I.P.C., Police Station Kotwali, District Unnao.

Learned counsel for the applicant argued that co accused Sushil Sahu has been enlarged on bail vide order dated 19.9.2024. Hence, the applicant who is languishing in jail since 26.6.2024 having no criminal history, may be released on bail on the ground of parity.

Learned A.G.A. opposed the prayer for bail but could not deny the ground of parity.

Considering and adopting the same reasonings as contained in paragraphs 3 and 5 of the bail order of co accused coupled with the fact that the applicant is languishing in jail since 26.6.2024 having no criminal antecedents, the applicant is also entitled to be released on bail on the ground of parity.

6. Accordingly, the bail application is allowed.

Let the applicant Jitendra Sahu be released on bail in the above said first information report number on his furnishing personal bonds and two reliable local sureties each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶14

(b) The applicant shall not commit any offence

¶15

similar to the offence of which he is accused or suspected of the commission; and

¶16

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
