Heard learned counsel for the applicant, learned A.G.A. for respondent State and learned counsel for the complainant.

The present application has been filed by the applicant seeking anticipatory bail in Case Crime No. 215 of 2024 under Section 323,324,504,506,308 I.P.C. Police Station Taalgaon, District Sitapur.

In brief, the prosecution case is that the accused persons on 1.6.2024 around 3.30 p.m. had abused and assaulted the complainant Mohd. Azhar and Afreen Bano with kicks and sticks and also threatned to kill them. It is alleged that injuries have been sustained by the injured.

A perusal of the record shows that there are three injured in this case. Mohd Azhar has sustained undisplaced hairline fracture of right side parietal bone of skull. There are two more injured persons. The statement of the injured are corroborated by the injury report. Complicity of the applicants are apparent. It cannot be said that it is a case of false implication. No case for anticipatory bail is made out.

Accordingly the application is dismissed.
