Heard learned counsel for the petitioner, learned A.G.A. for the State-respondent and perused the record.

In view of the proposed order being passed, notice to respondent Nos.2 & 3 are dispensed with.

By way of filing this petition, the petitioner has prayed for the following relief:-

"WHEREFORE it is prayed that in view of the facts, reasons and circumstances mentioned above this Hon'ble Court may kindly be pleased to direct the court below to decide the Complaint Case No. 7472/2017, U/s 138 N.I. Act, PSHazratganj, Lucknow, Mohd. Tarique Vs. M/s Akash Enterprises and its Proprietor namely Hasan Mehndi @Fahmi, pending in the Court of Additional Magistrate, Court No.2, Lucknow, within a period of six (6) months."

Learned counsel for the petitioner submits that petitioner has filed a complaint case under Section 138 of the Negotiable Instruments Act on 07.10.2017 since then the complaint case is pending. Trial is going on at a very slow pace. He prays that the trial to be expedited.

On due consideration to the submissions advanced, perusal of the record so also the provisions of Section 143(3) of the N.I. Act, the petition is disposed of with a direction to the learned trial court to expedite the trial proceedings as provided under Section 143(3) of the N.I. Act.
