Heard learned counsel for the applicants and learned A.G.A. for the State.

This application under Section 482 Cr.P.C. has been filed by the applicants for quashing order dated 26.06.2024 passed in Sessions Case No.132/2023: State vs. Ragini and others arising out of Case Crime No.288 of 2009, under Sections 323, 504, 308 IPC, Police Station Utraula, District Balrampur.

Learned counsel for the applicants has submitted that the applicants as well as complainant belongs to same family tree. It is, thus, submitted that there is a possibility of settlement of dispute, in case, the matter is sent for mediation in Mediation and Conciliation Centre of this Court, therefore, has requested for kind indulgence of this Court.

Learned A.G.A. has opposed the prayer of the applicant and he has no objection, in case, the matter is sent for mediation in Mediation and Conciliation Centre of this Court.

Considering the submissions of learned counsel for the applicant, learned A.G.A. and going through the contents of the application as well as other relevant documents; it is evident that applicants as well as complainant belongs to same family, hence, the possibility of settlement of dispute cannot be ruled out, therefore, the matter requires consideration.

Issue notice to the private respondent.

List this case on 14.01.2025.

¶10

On the next date, applicants and respondent no.2 shall appear before this Court.

¶11

Till the next date of listing, no coercive steps shall be taken against the applicants.
