Heard learned counsel for the parties.

By means of the present application, the applicants have approached this Court with a prayer to quash the entire proceedings of Criminal Misc. Case No. 95344 of 2022 (State vs. Shail Kumari and others), as appears from the pleadings as also the main prayer sought in the present application, which is extracted hereunder:-

"For the facts, reasons and circumstances stated in the accompanying affidavit, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to quash the entire proceedings of the Criminal Misc. Case No. 95344 of 2022 "State Versus Shail Kumari and others" arising out of charge sheet No. 01 of 2021 dated 03.12.2021 in pursuance of Case Crime No. 206 of 2021 Under Section 188, 147, 427, 504, 506 I.P.C. Police Station- Indira Nagar, District-Lucknow pending in the Court of Learned Additional Chief Judicial Magistrate IVth, Court No. 28, Lucknow as well as summoning order dated 06.10.2022 passed by Learned Additional Chief Judicial Magistrate IVth, Court No. 28, Lucknow, so far as it relates to the applicants (contained in Annexure No.1 & 2 to this affidavit), in the interest of justice."

The above quoted prayer has been sought on the main ground to the effect that to a civil dispute, criminal colour has been given.

In regard to aforesaid ground, learned counsel for the applicants has placed reliance on the order dated 27.12.2023 passed by Additional District Magistrate, City, Trans Gomti, Lucknow in Case No. 1716 of 2023, Computerized Case No. D202310460001716 (Smt. Ram Lali vs. Alok Kumar Agarwal), under Section 36(3) of U.P. Rent Control Act, 2021 (in short "Act of 2021").

It appears from above quoted order dated 27.12.2023 that the proceedings under the Act of 2021 were initiated by the applicant No. 1 by instituting a Case No. D202210460002755 and said order was passed on 23.02.2023. Vide order dated 23.02.2023, one Alok Kumar Agrawal was directed to vacate the area of Shop No. 14 situated at Mathur Market, Munshi Pulia Ward, Ismailganj, Indira Nagar, District Lucknow within 30 days. As Alok Kumar Agarwal failed to vacate the premises, an application dated 26.04.2023 was filed by the applicant No. 1/Smt. Ram Lali, whereupon, the final order dated 27.12.2023, quoted above, was

passed.

The record further indicates that an FIR was lodged on 03.08.2021 as FIR No. 0206 of 2021, wherein, allegations were levelled against the applicant No. 1/Smt. Ram Lali, Smt. Urmila Singh, Ajay Kumar Yadav @ Ajju and some other unknown females so as to attract the offences as indicated under Sections 188, 147, 427, 504 and 506 IPC. As per the FIR, the accused forcibly tried to evict the informant namely Pradeep Kumar Agrawal, undisputeldy tenant of the applicant No. 1, and also abused and threatened him for dire consequences and entire incident was recorded and there is a video clip related to the incident. Thereafter, the Investigating Officer conducted the investigation and after completion of investigation filed the charge sheet No. 1/2021 dated 03.12.2021.

A perusal of the relevant portion of the charge sheet indicates that the Investigating Officer filed the charge sheet after considering the statement of eye-witnesses and the video clip recording against the applicant No. 1/Smt. Ram Lali w/o late Manoj Kumar Rawat, applicant No. 2/Smt. Shail Kumari w/o Pradeep Kumar Rawat, Smt. Urmila Singh w/o Sunil Singh, Ajay Kumar Yadav @ Ajju @ Sushil Kumar s/o Shri Krishna.

Upon due consideration of the aforesaid facts particularly the facts related to video clip indicated in the FIR as also by the Investigating Officer in the charge sheet and to oppose the same, nothing has been pleaded in the instant application with appropriate proof, this Court finds no force in the present application. It is accordingly dismissed .
