1, The applicant before this Court has been summoned along with the co-accused to face trial in Complaint Case No. 947 of 2018 under Section 420 IPC by an order dated 17.01.2023 passed by the Additional Chief Judicial Magistrate, Kannauj.
- Mr. Mahendra Kumr Yadav, learned counsel for applicant submits that the dispute is essentially of civil nature. It has been alleged by complainant that applicant has deceived the coaccused Manoj to execute a bainama despite the fact that he was not owner of the land. The bainama was executed in favour of wife of the applicant.
- Learned counsel for the applicant further submits that till date the bainama has not been challenged before any civil court. Earlier an F.I.R. was lodged at behest of the applicant side against the complainant side.
- Learned counsel for the applicant further submits that the statement recorded under Sections 200 and 202 Cr.P.C. does not indicate that the ingredients of Section 420 IPC are made out.
