Heard learned counsel for the applicant, Shri Awadhesh Kumar Mishra, respondent No.3 in person as well as the learned AGA for the State and perused the record.

The present application under Section 482 Cr.P.C./Section 528 Bharatiya Nagrik Suraksha Sanhita, 2023 (in short "BNSS") has been filed by the applicant with the following main prayer:-

"To quash the impugned Charge sheet no. 01/2021, dated 28.12.2019 as submitted against the Applicant in Case No. 91190 of 2023, "State Of Uttar Pradesh Versus Saurabh Chawala And Others", U/S 406, 420 and 506 of I.P.C., 1860, Police Station- Kakori, Lucknow pending before the learned Court of A.C.J.M. Court No.30, Lucknow and also to quash the impugned summoning/cognizance order dated 24.08.2023 and the consequential processes issued by the Learned Court of Special Judge (SC/ST Act) to ensure the appearance of the Applicant therein and also to quash the entire proceedings of the said case."

Learned counsel for the applicant stated that the applicant is ready to settle the dispute amicably by way of mediation, as such, the matter may be referred to Mediation and Conciliation Centre of this Court so as to carve possibility of amicable settlement of dispute between the parties.

In view of above, it is provided that the matter be placed before Mediation and Conciliation Centre of this Court on 23.08.2024.

List/put up this case before this Court on 30.08.2024 alongwith mediation report.

Till the next date of listing, the proceedings in issue shall be kept in abeyance qua the applicant.
