Heard Sri U.C. Chaturvedi, counsel for the applicant, Sri Birendra Pratap Singh, learned AGA for the State and perused the record.

The present application under Sections 482 Cr.P.C. has been filed by the applicants Vinod Kumar Singh@Guddu, Pappu Singh@Ravi Bhushan Singh, Jagannath Singh, Sunil Singh, Amit Singh, with the prayer to quash the impugned cognizance order dated 18.11.2022 passed by Additional Chief Judicial Magistrate, Ghazipur and charge sheet no. 75 of 2022, dated 28.3.2022 as well as entire proceeding of Criminal Case NO. 47724 of 2022 (State vs. Vinod Singh@Guddu and others), arising out of Case Crime No. 385 of 2021, u/s 504, 506 I.P.C., Police Station Jamania, District Ghazipur, pending before the Additional Chief Judicial Magistrate, Ghazipur with the further prayer to stay the further proceedings of the said criminal case during pendency of the present petition.

After arguments at length, learned counsel for the applicants submits that he does not press the prayers made in the present application under Section 482 Cr.P.C. on merits and submits that liberty may be granted to him to seek discharge in the present case.

Needless to state that if an accused-applicants claim discharge at the appropriate stage, the trial court shall consider the same in accordance with law.

The present application is disposed of.
