Heard learned counsel for the applicants as well as the learned AGA for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicants with a prayer to quash the charge sheet dated 30.08.2017 arising out of Case Crime No. 0431 of 2016, under Sections 498-A, 323, 504, 506, 354 IPC and Section 3/4 D.P. Act, Police Station- Banthara, District- Lucknow as well as summoning order dated 18.08.2018 and NBW order dated 16.10.2023 passed in Case No. 48336 of 2018 and further to stay the proceedings of Case No. 48336 of 2018.
Learned counsel for the applicants stated that the applicants are ready to settle the dispute amicably by way of mediation, as such, the matter may referred to mediation and conciliation centre of this Court to carve out the possibility of amicable settlement of dispute between the parties.
In view of above, it is provided that the matter be placed before Mediation and Conciliation Centre of this Court on 31.07.2024. The applicants shall deposit an amount of Rs. 35,000/- before the Mediation and Conciliation Centre of this Court within a period of two weeks from today, which shall be released in favour of the opposite party No. 2 forthwith.
Issue notice to the opposite party No. 2. Steps in this regard be taken within three working days.
List/put up this case before this Court on 22.08.2024 alongwith mediation report as fresh.
Till the next date of listing, the proceedings against the applicants shall be kept in abeyance.
In case, the amount aforesaid is not deposited by the applicants within the specified time, the interim protection granted by this Court shall not be available to them.
