Shri Avanindra Singh Parihar, Advocate has put in appearance on behalf of opposite party no. 2 in Court today and has filed Vakalatnama which is taken on record.

The present application has been filed for setting aside the impugned charge sheet dated 13.01.2024 and impugned summoning order dated 05.04.2024 passed by learned Additional Chief Judicial Magistrate III, Lucknow under Sections 498-A, 323, 452, 504, 506 IPC in Crime No. 0474 of 2023 at Police Station - Chinhat, District - Lucknow.

It is stated by learned Counsel for the applicant that the dispute which is matrimonial dispute could be settled and decided amicably by way of mediation. To show the bona fide, it is stated that the applicant no. 1 would deposit Rs. 50,000/- (Rupees Fifty Thousand Only) before the Mediation and Conciliation Centre of this Court within two weeks from today.

Considering the submissions advanced by the learned counsel appearing for the applicant including that dispute between the parties can be settled amicably by way of mediation, this Court finds that the matter requires consideration.

Taking note of the aforesaid, let the matter be placed before Mediation and Conciliation Centre of this Court on 25.07.2024 . The applicant no.1 shall deposit an amount of Rs. 50,000/- before the Mediation and Conciliation Centre of this Court within two weeks from today, which shall be released in favour of the opposite party No. 2/Smt. Bindu Verma.

List/put up this case before this Court on 16.08.2024 as fresh along with mediation report in this regard showing the name of Shri Avanindra Singh Parihar, Advocate as counsel for opposite party no. 2.

Till the next date of listing, the proceedings in issue against the

applicants shall be kept in abeyance.

In case, the amount aforesaid is not deposited by the applicant no. 1 within the specified time, the interim protection granted by this Court shall not be available to applicants.

Learned counsel for the parties shall ensure the presence of the parties before the Mediation and Conciliation Centre of this Court on the date fixed by this Court.
