Heard learned counsel for the petitioner as well as learned AGA for the State and Shri Shailendra Pratap Singh, learned Advocate appearing on behalf of respondent no. 2 who has filed vakalantama on behalf of the complainant/opposite party no. 2 which is taken on record.

Learned counsel for the petitioner submits that during pendency of the investigation, a criminal misc. anticipatory bail application U/S 438 of Cr.P.C. No. 204 of 2024 was filed by the applicant before this Court which was allowed vide order dated 06.02.2024 and protection was given to the applicant till filing of the police report. It has been further submitted that on the same very evidence, the police report has been filed.

Learned counsel for the petitioner, at this stage, prays that the petition may be dismissed with liberty to file anticipatory bail.

Learned AGA submits that no liberty is required to the petitioner to move the anticipatory bail application. It is always open for him to file the application for anticipatory bail application.

In view of the above, so also the observations made by the Court in the order dated 06.02.2024 passed in anticipatory bail application No. 204/2024, the petition is dismissed with liberty to the petitioner to move appropriate anticipatory bail application.
