Heard Sri Pradeep Saxena, learned counsel for the applicant and Sri Ramesh Kumar, learned A.G.A. for the State.

The present application has been filed to quash the summoning order dated 12.11.2010 passed by A.C.J.M., Kashi Ram Nagar (Kasganj) as well as entire proceeding of Complaint Case No.1313 of 2010 (Old) New Case No.1537 of 2020 (Smt. Manish Kumari Vs. Narayan Singh and others), under Sections 498-A I.P.C. and 3/4 D.P. Act, Police Station Soron, District Kasganj, pending in the court of Civil Judge (Junior Division)/ Judicial Magistrate/FTC/Offence against Women District Kasganj.

After some arguments, learned counsel for the applicant confining his prayer to the extent of expediting the trial of complaint case in question on the ground that this complaint case is pending since 2010 and during pendency of this proceeding though the parties have settled their dispute but subsequently they again started living separately because of matrimonial discord.

Considering the aforesaid submission and taking into account the impugned proceeding has been arising out of offence against the woman, therefore, the court below is directed to decide the Complaint Case No.1313 of 2010 (Old) New Case No.1537 of 2020 (Smt. Manish Kumari Vs. Narayan Singh and others), under Sections 498-A I.P.C. and 3/4 D.P. Act, Police Station Soron, District Kasganj, as early as possible without giving unnecessary adjournment to either of the parties.

With the aforesaid observation, the present application is disposed of .
