Heard learned counsel for the applicants and learned A.G.A. for the State.

This application under Section 482 Cr.P.C. has been filed by the applicants to quash the charge sheet dated 02.07.2023 as well as cognizance order dated 30.11.2023 passed by the Chief Metropolitan Magistrate, Kanpur Nagar in Criminal Case No. 189376 of 2023 arising out of Case Crime No. 90 of 2023, under Section 147, 323, 352, 504 & 506 IPC, Police Station - Rail Bazar, (East Commissionerate), District - Kanpur Nagar on the basis of compromise took place on 23.11.2024 between the parties and also prayed to stay the further proceedings.

Counsel submits that the matter has been amicably settled between the parties.

Counsel for opposite party no. 2 has acknowledged that there is a compromise between the parties and affidavit in this regard has been filed which is annexed as Annexure-5 to the present application.

List again on 22.1.2025 as fresh.

¶8

The parties will appear before the trial court on 18.12.2024 or any other date fixed by the Court of CMM, Kanpur Nagar, who will record the statement of the parties and submit report before the next date of listing.

In the meantime, considering the compromise, no coercive action shall be taken against the applicants in Criminal Case No. 189376 of 2023 arising out of Case Crime No. 90 of 2023, under Section 147, 323, 352, 504 & 506 IPC, Police Station - Rail Bazar, (East Commissionerate), District - Kanpur Nagar.
