- The present 482 Cr.P.C. application has been filed to direct the Court of learned Metropolitan Magistrate-4, Kanpur Nagar, to proceed with the Complaint Case No. 6119 of 2015 (Gurubhej Singh Vs. Harpreet Singh and others) under Section 6 of Dowry Prohibition Act, Police Station Govind Nagar, District Kanpur Nagar in accordance with law securing the presence of opposite party nos. 2 to 5 and the opposite party nos. 2 to 5 may also be directed to cooperate with the trial in accordance with law.
- Contention of learned counsel for applicant is that initially the opposite party nos. 2 to 5 filed a petition under Section 482 Cr.P.C. 37858 of 2016 challenging the impugned proceeding of Complaint Case No. 6119 of 2015 in which interim order was granted. Subsequently, interim order was not extended by order dated 19.11.2017. Thereafter the opposite party no. 2 to 5 again challenged the proceedings of Complaint Case by filing 482 No. 22682 of 2023 and obtained interim order which is still pending, therefore, all the petitions may be heard together as because of pendency of those petitions trial could not be concluded.
