- Heard Sri Pradeep Kumar Singh, learned counsel for the applicant and Sri Birendra Pratap Singh, learned counsel for the State and perused the records.
- The present application under Section 482 Cr.P.C. has been filed by the applicant- Naseem Bano, with the prayer to allow the present application and quash the entire proceeding as well as charge-sheet dated 24.04.2023 & summoning order dated 11.07.2023 in Special Case No. 1527 of 2023 (State Vs. Arun Kumar Srivastava and others) arising out of Case Crime No. / FIR 1084 of 2018, under Sections 420 I.P.C., Police Station Civil Lines, District Moradabad, pending in the court of Special Judge (Prevention of Corruption Act, 1988) Special Court No.2, District Moradabad, with a further prayer that proceedings of the aforesaid case be stayed.
- Learned counsel for the State prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within three weeks thereafter.
