The instant application under Section 482 Cr.P.C. has been preferred by the applicants with a prayer to quash the proceedings of Criminal Case No. 406 of 2019 (State Vs. Gyanendra and others) arising out of Case Crime No. 157 of 2018, under Sections 147, 148, 323, 307, 504, 506 I.P.C., Police Station Gursahaiganj, District Kannauj, pending in the court of learned Judicial Magistrate, Kannauj on the basis of compromise.
On the matter being taken up, learned counsel for the applicants submits that on account of some defects, the applicants do not want to press this application, therefore, they may be permitted to withdraw this application with liberty to file fresh application with better particulars.
Learned Additional Government Advocate for the State has no objection to such prayer of the applicants.
In view of the above, the instant application is dismissed as withdrawn with liberty as prayed for.
