Heard Rishabh Tiwari, Advocate holding brief Sri A.Z. Khan, learned counsel for the applicant and Sri Ajay Kumar Sharma, learned A.G.A. appearing on behalf of opposite party no.1-State.

Application under Section 482 Cr.P.C. has been filed seeking quashing of entire proceedings of Special Case No. 316 of 2024 (State vs. Istaq @ Kallu) under Section 376, 328 & 419 I.P.C. and 3/4 POCSO Act, arising out of Case Crime No. 506 of 2023, Police Station- Sadar Bazar, District-Saharanpur as well as summoning order dated 30.01.2024.

After arguing at some length, learned counsel for the applicant, on the basis of instructions from the applicant submits that he does not want to press the application at this stage and prayed for liberty to be granted to the applicant to file a discharge application before the trial court concerned, which may be directed to be decided expeditiously. It has also been submitted by the learned counsel that the applicant is already enlarged on bail.

Learned A.G.A. does not have any objection to the prayer so made by the learned counsel for the applicant.

In view of the prayer made and without entering into the merits of the case, liberty is granted to the applicant to file discharge

application in the aforesaid case before the Trial Court, which shall be considered and decided expeditiously and in accordance with law.

The application therefore, stands disposed of .
