5.After hearing the learned counsel for the parties, this Court finds that the court below has rightly held while deciding Point No. 3, that under Section 125 of the Cr.P.C., for a wife to claim maintenance, she must prove that she is unable to maintain herself. The court below has relied upon judgments passed by the Hon'ble Supreme Court in Bhagwan Dutt vs Kamla Devi, AIR 1975 SC 83 and C haturbhuj vs Sita Bai, 2021 (117) SCC 60 , wherein it has been held that if a wife is unable to maintain herself, she is entitled to maintenance that matches her husband's standard of living. In the present case, it has been shown that the applicant is a postgraduate and works in a private company, but her income is less than that of her husband. Hence, the court believes that the wife is entitled to maintenance according to her husband's standard of living, even though she is employed. This Court has no hesitation in holding that the impugned order does not suffer from any illegality or impropriety warranting any interference by this Court.
