Heard learned counsel for the applicant, learned AGA for the State and perused the record.

The instant application has been filed for a direction to decide the S.T. No. 213 of 2022 (State vs. Ajay Kumar and others), arising out of Case Crime No. 262 of 2020, under Sections 147, 323, 324, 504, 506 and 307 I.P.C., P.S. Madiyahu, District-Jaunpur, pending in the court of Additional Sessions Judge-II, Jaunpur, expeditiously within a stipulated period or as early as possible.

Learned counsel for the applicant quoting the aforesaid prayer submits that the matter is still pending consideration since 2021 and the applicant is suffering due to delay in conclusion of the trial proceedings. He submits that the interest of justice would be subserved if this Hon'ble Court is pleased enough to direct the Court below to conclude the trial proceedings in Case No. 156 of 2019 under section 125 of Cr.P.C. within a stipulated period of time as may be fixed by this Court.

The counsel appearing for the State has no objection to the contention aforesaid.

Considering the submissions of the learned counsel for the parties, the Trial Court is hereby directed to conclude the proceeding of S.T. No. 213 of 2022 (State vs. Ajay Kumar and others), arising out of Case Crime No. 262 of 2020, under Sections 147, 323, 324, 504, 506 and 307 I.P.C., expeditiously without granting unnecessary adjournment to either of the parties, if there is no legal impediment, while considering the guidelines and circulars issued in this regard.

The application is disposed off accordingly.
