Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Principal Judge, Family Court (First), Varanasi to decide the application dated 19.12.2022 filed in Case No. 257 of 2021 (Krishna Yadav vs. Pradeep Kumar Yadav), under Section - 125 Cr.P.C., Police Station - Maduwadeeh, District - Varanasi, within time stipulated by this Court, which is pending before the aforesaid court.

It is submitted by learned counsel for applicant that applicant is husband of the opposite party no.2 and she has filed the aforesaid case under Section - 125 Cr.P.C. During proceedings of that case, applicant has moved an application dated 19.12.2022 but that application has not been decided so far and thus, a direction may be made to the family court concerned to decide the said application expeditiously within specific time frame.

In view of aforesaid, the concerned Family Court is directed to decide the aforesaid application dated 19.12.2022 filed by the applicant in aforesaid case expeditiously, preferably within a

period of three months from the date of production of copy of this order before the family court concerned.

The application under Section 482 Cr.P.C. is disposed of accordingly.
