Heard learned counsel for the applicants and learned A.G.A. for the State.

It is submitted by learned counsel for the applicants that applicant no.1 is wife of opposite party no.2/complainant. Earlier, she has filed a case under Sections - 498A, 323, 504, 506 I.P.C. and 3/4 D.P. Act against opposite party no.2 and his family members. One more case was filed by applicant no.1 under Section - 125 Cr.P.C. against opposite party no.2. Thereafter impugned complaint has been filed by the opposite party no.2 as a counter-blast to the said cases and thus, the impugned proceedings are liable to be quashed.

Matter requires consideration.

Issue notice to opposite party no.2, returnable at an early date.

Opposite party no.2 may file counter affidavit within four weeks.

List this case in the second week of January, 2025 .

It is directed that till the next date of listing, no coercive action shall be taken against the applicants, namely, Smt. Deepti and Smt. Sarita in Complaint Case No. 72 of 2023 (Vishnu Kumar vs. Deepti and Others), under Sections - 379, 506, 452, 504 I.P.C., Police Station - Chhibramau, District - Kannauj, pending in the court of Addl. Civil Judge (J.D.)/Judicial Magistrate, Chhibramau, Kannauj.
