Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material placed on record.
The present 482 Cr.P.C. application has been filed with a prayer to quash the charge sheet dated 15.04.2023 and summoning order dated 31.10.2023 passed by Chief Judicial Magistrate, Gonda as well as the entire criminal proceedings of Case No.22557 of 2023 (State of U.P. vs. Shekhar and others arising out of Case Crime No.32 of 2023 under Section 406 IPC., Police Station Colonelganj, District Gonda.
At the very outset, counsel for the applicant states that the applicant will surrender before the court below and apply for bail. However, he has submitted that the applicant may be granted the benefit of the case of Satender Kumar Antil Vs. Central Bureau of Investigation and another reported in (AIR 2022 SC 3386).
It is therefore, directed that in case the applicant surrenders before the Court below within fifteen days from today and prefer bail application, the court below will decide the said bail application, as expeditiously as possible, taking into account the law laid down by the Supreme Court in Satender Kumar Antil (supra) and decide it in accordance with law.
The application stands disposed of.
